This was one of those cases where, if I were the developer, I probably would have said, "Well, if I don't make the buttload of money, someone else will steal the idea and make lots of money off it, so it might as well be me."

His ability to make money is limited by the plain copyright infringement he has with Nintendo. He can't easily claim exclusive rights to it. So, that laid the opportunity for a bunch of others to create knock-offs, like what Facebook has done.

Was there legal action taken on Nintendo's part(I'm not aware of any)? It's pretty irrelevant, in terms of others making knock offs(of a knockoff(games are all knockoffs of each other)).
