His ability to make money is limited by the plain copyright infringement he has with Nintendo. He can't easily claim exclusive rights to it. So, that laid the opportunity for a bunch of others to create knock-offs, like what Facebook has done.

Was there legal action taken on Nintendo's part(I'm not aware of any)? It's pretty irrelevant, in terms of others making knock offs(of a knockoff(games are all knockoffs of each other)).
