Oh, I forgot about this one. I've been meaning to watch it partly because Philip Seymour Hoffman has a lead role in it and I'm a big fan of PSH. Thank you for the reminder.

yes.

why/why not?
The way he acted when questioned...the wine incident...what the boy's mother said

Vague evidence, but, evidence nonetheless.

since i dont' feel like writing up my own explanation of why i think he he did'nt do it, i'll steal this from yahoo answers (basically sums up my feeling on the matter):

I don't think he did it. As to the question, if he didn't do it, why did he leave? He left because he realized that Meryl's character would never stop pursuing the issue at any cost (including at the cost of Donald Miller's life). As you might recall, during his argument with Meryl's character the priest raised the fact that Donald's father was physically abusive. The priest was also quite taken aback by the fact that Meryl's character refused to follow the chain of command and had gone so far as to call Mrs. Miller to the office on suspicion alone. His compassion was more important to the priest than his reputation or proving a point to Meryl's character. He was not going to let Meryl's character kill that with her contempt or intolerance. Intolerance is also the reason why the blonde kid smiles at the end -- if you recall the blond kid also pushed/harassed Donald Miller --- I'd get into this part of the movie further but I have to get back to work.

and also he just generally didn't come across as a creeper to me. he seemed like a genuinely compassionate guy. i can honestly say if i was in his position, i probably would have acted the same way. and meryl was just ruthless, her vision was tainted by preconceived notions and utter bias and absolutely no evidence... so yeah.

I think shoeless's spoiler is a really good answer. I would add that if the movie had resolved the issue that would have been a true spoiler because it as is leaves us with the possibilities that occur in real life.
